Johnson Law Corporation is a Denver (Centennial-Littleton) Colorado based law firm. Founded in 1994 by Maurice Johnson, it specializes in family and divorce law, business, estate planning and trusts, tax planning, real estate, civil litigation, bankruptcy, and related appeals. Mediation services are also provided in these subject areas.

Today the practice of law in Colorado is rapidly changing. The wise use of technology is providing our clients with access to less expensive but more thorough legal services. This increase in efficiency allows a wider range of legal services to be provided at less cost.

Additionally, the Colorado courts are also implementing procedures to further reduce the cost of dispute resolution. Early status conferences with the Judge and mandatory third party mediation are now routinely required. Judges now have more tools to "force" an early and less expensive resolution, especially in divorce and general litigation cases.

The real value today is provided through accurate legal analysis - the application of law to specific facts. Not through the completion of standard legal forms or the needless protraction of endless litigation. Too often disputes drag on and on at great expense because one of the parties in the dispute does not understand his or her rights and liabilities.

Johnson Law Corporation focuses on an accurate legal analysis and the communication of that analysis to all parties, including the opposing party. The real objective is to resolve the matter and move on.

One of the purposes of this web site is to provide expert guidance on specific legal topics. A number of standard Colorado legal forms are also included, particularly for real estate transactions.

1. Colorado Divorce and Family Law
Colorado law on divorce and other aspects of family law are complex and often confusing. 2. Mediation (Instead of Litigation)
Mediation is a more efficient and less costly process of resolving disputes. Mediation also provides better predictability of the outcomes for all parties. It is particularly effective in divorce and other family law matters.

Our competitive society has become a way of life which generates many disputes. Many disputes can be resolved without formal court litigation. However, some will require a decision by a Judge or jury. We represent plaintiffs and defendants in dispute resolution and lawsuits for damages based on fraud, breach of contract, negligence, money owed, and civil disputes.

4. Colorado Estate Planning and Administration; Probate
Estate planning in Colorado should address family needs and personal development both during lifetime and after death. Most families are best served by the avoidance of court-supervised probate, guardianships, and conservatorships. The applicable tools include wills, trusts, powers of attorney, living wills, and tax/business planning. Pre-nuptial and Post-Nuptial Agreements are now often a part of estate planning.

As of July 1, 2006, new Colorado law provides increased protection to the creditors of insolvent estates.

6. Colorado Bankruptcy
Protection from debt collectors is provided to those who cannot meet their financial obligations, particularly for business setbacks or unpaid medical bills. Many divorces result in a bankruptcy filing for one or both spouses. Most assets of the debtor can be protected through a bankruptcy filing. Under the new October 2005 law, a bankruptcy filed after a divorce proceeding may no longer work to discharge debt allocated in the divorce. Do your planning early.

7. Retirement Plan QDRO for Divorces
Pension and other retirement plans which are divided at the time of divorce must be divided using a Qualified Domestic Relations Order ("QDRO.") Using a QDRO will avoid any income taxes at the time of the division. A QDRO applies to 401(k) plans, government plans, and all pension plans. Colorado state employees can use a similar plan, called a DRO.

A QDRO can also be used to collect past-due child support or maintenance (alimony.)

8. Colorado Business Entities; Asset Protection
Asset protection and tax reduction generally includes the use of separate business entities to isolate business liability. Our work includes planning, formation, buy-sell agreements among owners, and the sale of business assets or the entire business entity.

For many small businesses, a single member limited liability company which is taxed as a schedule C proprietorship is a good and inexpensive choice of entity.
